Subscription Agreement
1. Introduction
This Subscription Agreement is entered into between you, governing your use of the premium subscription services provided by the Vivety app. Vivety is a lightweight AI photo editing app that automatically detects and removes strangers, clutter and unwanted elements from photos, intelligently restores backgrounds seamlessly, with easy operation, natural editing effects, and quick saving and sharing functions.
The Premium Services provide additional advanced features beyond the free version of the App, including but not limited to ad-free editing, high-resolution output, batch editing, and exclusive AI repair tools. By subscribing to the Premium Services, you agree to be bound by all the terms and conditions set forth in this Agreement.
It is important to note that Vivety does not collect any facial information from users, ensuring your privacy is protected throughout your use of the App and its Premium Services.
2. Subscription Eligibility
To subscribe to the Premium Services, you must be of legal age to enter into a binding agreement in your jurisdiction. If you are a minor, you may only subscribe to the Premium Services with the prior consent and supervision of your parent or legal guardian, who shall be responsible for complying with this Agreement on your behalf.
You warrant that you have the necessary right, authority, and capacity to agree to this Agreement and use the Premium Services. The App does not require account registration to use its free features, but to access the Premium Services, you may need to complete a simple subscription process through your device’s official app store, which will be governed by the terms of service of the respective app store.
3. Premium Services Description
The Premium Services include, but are not limited to, the following exclusive features:
- Ad-free experience: No third-party advertisements will be displayed while using the App’s editing functions.
- High-resolution output: Edit and save photos in high resolution without quality loss.
- Batch editing: Edit multiple photos at once, saving time and effort.
- Exclusive AI repair tools: Advanced AI algorithms to restore photos more accurately, remove complex clutter, and optimize image details.
- Priority support: Access to dedicated customer support to resolve any issues or inquiries promptly.
- Regular feature updates: Early access to new premium features added to the App from time to time.
All Premium Services are provided on an “as is” basis, and the Developer reserves the right to modify, add, or remove features of the Premium Services at any time, provided that such changes do not materially reduce the overall functionality of the subscribed services.
4. Subscription Terms and Payment
4.1 Subscription Period: The Premium Services are available on a subscription basis, with multiple options including monthly, quarterly, and annual subscriptions (each, a “Subscription Period”). The specific duration and pricing of each Subscription Period will be displayed in the App and the respective app store at the time of subscription.
Upon the expiration of your current Subscription Period, your subscription will automatically renew for another period of the same duration, unless you cancel the automatic renewal at least 24 hours before the end of the current period, in accordance with the cancellation procedures provided by your app store.
4.2 Payment: By subscribing to the Premium Services, you agree to pay the subscription fee specified for the selected Subscription Period, which will be charged to your designated payment method (e.g., credit card, app store account balance) at the time of subscription and upon each automatic renewal.
The subscription fee is non-refundable, except as required by applicable law or as explicitly stated in this Agreement. The Developer reserves the right to adjust the subscription fee from time to time, but any fee changes will not apply to your current Subscription Period.
5. User Obligations
While using the Premium Services, you agree to:
- Comply with all applicable laws, regulations, and ethical standards.
- Not use the Premium Services for any illegal, harmful, or unauthorized purpose.
- Not reverse engineer, decompile, modify, tamper with, or bypass security measures.
- Not share your subscription access with any third party (individual, non-commercial use only).
- Maintain the security of your device and subscription credentials, and notify the Developer if you suspect unauthorized use.
6. Developer Rights and Responsibilities
6.1 The Developer reserves the right to suspend or terminate your access to the Premium Services if you violate any terms of this Agreement, including but not limited to non-payment of subscription fees, unauthorized use, or violation of applicable laws.
6.2 The Developer is responsible for providing the Premium Services as described in this Agreement, but does not guarantee that the App or Premium Services will be free of errors, interruptions, or downtime.
6.3 As previously noted, the Developer does not collect any facial information from users, and all photos you upload or edit using the App are stored locally on your device, with no access or collection by the Developer or any third parties.
7. Cancellation and Refunds
You may cancel your subscription and automatic renewal at any time through your device’s app store settings. To avoid being charged for the next Subscription Period, you must cancel at least 24 hours before the end of your current period.
Upon cancellation, you will continue to have access to the Premium Services until the end of your current Subscription Period, after which your access will revert to the free version of the App. No refunds will be provided for any unused portion of the subscription period, except as required by applicable law.
8. Intellectual Property Rights
All intellectual property rights in the App, Premium Services, including but not limited to software, algorithms, features, logos, text, and graphics, are owned by the Developer. You are granted a limited, non-exclusive, non-transferable license to use the Premium Services for personal, non-commercial purposes during your subscription period.
All photos you edit using the App remain your property, and the Developer does not claim any ownership rights to your content.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Premium Services.
The Developer’s total liability to you for any claims arising under this Agreement shall not exceed the amount you paid for the current Subscription Period.
10. Changes to This Agreement
The Developer may update this Agreement from time to time to reflect changes in the Premium Services, applicable laws, or the Developer’s business practices. Any changes will be posted within the App, and your continued use of the Premium Services after the changes take effect will constitute your acceptance of the updated Agreement.
